Safety production regulations for metallurgical enterprises and non-ferrous metals enterprises

Chapter I General

Article 1 In order to strengthen the safety production of metallurgical enterprises and non-ferrous metal enterprises, prevent and reduce production safety accidents and occupational diseases, and ensure the safety and health of employees, the People's Republic of China Safety Production Law and the Law of the People's Republic of China on the Prevention and Control of Occupational Diseases Provisions.

Article 2 These regulations apply to the safe production (including occupational health, the same below) and supervision and management of metallurgical enterprises and non-ferrous metal enterprises (hereinafter collectively referred to as enterprises).

The safe production, supervision and management of metal smelting activities in mechanical casting enterprises shall be implemented in accordance with these Provisions.

Article 3 The term "metallurgical enterprises" as used in these Regulations refers to enterprises engaged in the production activities of ferrous metal smelting and rolling processing industries.

The term "non-ferrous metal enterprises" as used in these Regulations refers to enterprises engaged in production activities such as non-ferrous metal smelting and rolling processing industries.

Metal smelting referred to in these Regulations refers to the production activities of metallurgical enterprises and non-ferrous metal enterprises engaged in high-temperature molten metal and slag (hereinafter referred to as high-temperature molten metal) that meet the national scale (volume).

The specific catalogue of ferrous metal smelting and rolling processing industry, non-ferrous metal smelting and rolling processing industry shall be formulated and promulgated by the State Administration of Work Safety and Administration in accordance with the National Economic Industry Classification (GB/T4754).

Article 4 Enterprises are the responsible subjects of production safety. The enterprise shall bear the management responsibility for the safe production of the branches of the enterprise that do not have legal person status.

Article 5 The State Administration of Work Safety shall guide and supervise the safety production of metallurgical enterprises and non-ferrous metal enterprises throughout the country.

The safety production supervision and administration department of the local people's government at or above the county level and the relevant departments (hereinafter referred to as the department responsible for the supervision of metallurgical and colored safety production) shall, in accordance with the duties stipulated by the people's government at the same level, in accordance with the principle of territorial supervision and grading responsibility, within the administrative region. The metallurgical enterprise and the non-ferrous metal enterprise's safety production work implementation supervision and management.

Chapter II Safe Production Guarantee of Enterprises

Article 6 An enterprise shall abide by the provisions on safety production laws, administrative regulations, rules, and national or industrial standards.

Enterprises should establish a dual prevention mechanism for safety risk management and accident hazard investigation and management, and implement safety risk management and accident hazard investigation and responsibility system from the main responsible person to each employee.

Article 7 An enterprise shall carry out safety production standardization construction work in accordance with regulations, promote systemization of safety and health management, standardization of post operation behavior, intrinsic safety of equipment and facilities, and fixed installation of working environment appliances, and continuous improvement.

Article 8 An enterprise shall establish and improve a safety production responsibility system for all employees. The principal responsible person (including the legal representative and the actual controller, the same below) is the first responsible person for the safe production of the enterprise and is fully responsible for the safety production of the enterprise; Other responsible persons are responsible for the safety production work within the scope of the management; the responsible persons of each functional department are responsible for the safety production work within the scope of their duties.

Article 9 The principal person in charge of an enterprise shall report the safety production status of the enterprise to the shareholders' meeting or the employee representative assembly every year, and accept the supervision of the shareholders and employees on the work of safety production.

Article 10 If a metal smelting process exists in an enterprise, if the number of employees is more than 100, a safety production management organization or a full-time safety production management personnel of not less than three-thousandths of the employees shall be set up, but the minimum is not less than three; If the number of employees is less than one hundred, the safety production management organization or full-time safety production management personnel shall be set up.

Article 11 The main person in charge of the enterprise and the safety production management personnel shall receive safety production education and training, and have the safety production knowledge and management ability appropriate to the production and operation activities of the enterprise. Among them, the main person in charge of the metal smelting process and the safety production management personnel must accept the safety production knowledge and management ability assessment of the department responsible for metallurgical and non-ferrous production safety supervision within six months from the date of appointment. And the assessment is qualified.

Enterprises shall conduct safety production education and training for employees in accordance with relevant state regulations, ensure that employees have the necessary safety production knowledge, understand relevant safety production laws and regulations, be familiar with the company's rules and regulations and safety technical operation procedures, and master the safe operation skills of this position. And establish training files to record training and assessment. Those who are not qualified for safety production education and training shall not be allowed to work.

The enterprise shall conduct safety production education and training for the newly-employed employees in the factory (company), workshop (functional department), and class; the employees who are re-employed for adjusting their posts and leaving the post for more than half a year shall go through the workshop (functional department). After the team's safety production education and training are qualified, they can only work on the job.

Before the new technology, new technology, new materials and new equipment are put into use, the enterprise shall conduct special safety production education and training for the relevant operation personnel.

Article 12 Special operations personnel engaged in gas production, storage, transportation, use, maintenance and repair operations must be trained in special safety technology according to law, and after passing the examination, they can obtain the "Special Operation Operation Certificate of the People's Republic of China". Work on the job.

Article 13 The safety facilities and occupational disease prevention facilities of new construction, reconstruction and expansion projects (hereinafter collectively referred to as construction projects) shall strictly implement the relevant provisions of the State on safety production, occupational disease prevention and control laws, administrative regulations and national standards or industry standards, and The main project is designed, constructed and put into production and use at the same time. Investment in safety facilities and occupational disease prevention facilities should be included in the construction project budget estimates.

Article 14 In the feasibility study stage of the metal smelting construction project, the construction unit shall conduct safety evaluation according to law.

Construction project In the preliminary design stage, the construction unit shall entrust a design unit with national qualifications to design its safety facilities and prepare safety facilities.

Before the construction project is completed and put into production or used, the construction unit shall carry out the completion and acceptance of the safety facilities in accordance with relevant regulations.

Article 15 The State Administration of Work Safety is responsible for the implementation of the safety facility design review of metal smelting construction projects approved (approved and filed) by the State Council.

The departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government that have the responsibility for metallurgical and non-ferrous production safety supervision shall implement the guidance and supervision of the metal smelting construction projects within their respective administrative areas, and determine and publish the relevant departments of the administrative region for the design review of the safety facilities of metal smelting construction projects. Jurisdiction.

Article 16 An enterprise shall identify various types of risk factors existing in the enterprise, set safety warning signs in accordance with the requirements of relevant national standards and industry standards in places and facilities and equipment with large risk factors, and conduct regular inspection and maintenance. .

For identified major hazards, enterprises should register and file, monitor and monitor, regularly test and evaluate, formulate emergency plans and conduct emergency drills on a regular basis.

The enterprise shall report the major hazard sources and related safety measures and emergency plans to the relevant local people's government for the record of the metallurgical and colored safety production supervision duties.

Article 17 An enterprise shall establish an emergency rescue organization. If the production scale is small, emergency rescue organizations may not be established, but part-time emergency rescue personnel shall be designated, and an emergency rescue agreement may be signed with the adjacent emergency rescue team.

Enterprises should be equipped with necessary emergency rescue equipment, equipment and materials, and carry out regular maintenance and maintenance to ensure normal operation.

Article 18 An enterprise shall take effective measures to prevent, control and eliminate occupational disease hazards and ensure that occupational health conditions in the workplace comply with laws, administrative regulations, and national or industrial standards.

Enterprises shall regularly test and evaluate the occupational disease hazards existing in the workplace, and the test results shall be announced in a conspicuous position of the enterprise.

Article 19 An enterprise shall strengthen occupational health surveillance in accordance with relevant regulations. Workers who are exposed to occupational disease hazards shall organize occupational health examinations before, during and after their posts, and inform the practitioners of the results of the inspections and Establish an occupational health surveillance file.

Article 20 An enterprise shall strengthen the safety management of key projects such as construction and overhaul, and the contractors of production and operation projects and places, and shall not issue relevant projects, projects or places to units that do not have safe production conditions or corresponding qualifications. The contractual agreement between the enterprise and the contractor shall clearly stipulate the safety production responsibilities and obligations of both parties.

The enterprise shall conduct unified coordination and management of the safety production of the contractor, review the safety measures and emergency measures in the maintenance plan of the contractor engaged in the overhaul project, and supervise the implementation of the contractor.

The enterprise shall conduct safety disclosure on the contracted maintenance work site, and arrange special personnel to be responsible for safety inspection and coordination.

Article 21 An enterprise shall hire labor service personnel from a legal labor service company and sign a contract with the labor service company to conduct unified safety production education and training for the labor service personnel.

Article 22 If the normal production activities of an enterprise are carried out simultaneously with the construction or maintenance activities of other units in the same operation area of the enterprise, the enterprise shall designate a full-time safety production management personnel to be responsible for the safety inspection work at the operation site, and relevant work activities. Conduct unified coordination and management.

Article 23 An enterprise shall establish and improve a safety management system for equipment and facilities, strengthen inspection, maintenance, maintenance and overhaul of equipment and facilities to ensure the safe operation of equipment and facilities.

For electrical, mechanical and other equipment in important positions, enterprises shall implement an operating card system.

Article 24 An enterprise shall not use technologies, processes and equipment that do not conform to national standards or industry standards; it shall not reduce its safety technical performance if it is to update or modify existing processes and equipment.

Article 25 The construction (structure) of an enterprise shall take protective measures against fire, explosion, lightning, earthquake, corrosion, heat insulation, etc. in accordance with national standards or industry standards, and bear heavy loads, load changes or Buildings (structures) that are endangered by high-temperature molten metal splashing, acid-base corrosion, etc., should be inspected regularly for the construction (structure) structure.

Article 26 If an enterprise reforms the lifting equipment and increases the load, it shall simultaneously verify the load-bearing structure of the load-bearing plant and take necessary reinforcement measures for the load-bearing structure to ensure that the load-bearing structure has sufficient load-bearing capacity.

Article 27 The operation room, conference room, activity room, lounge, locker room, etc. of the enterprise shall not be placed within the influence range of high-temperature molten metal lifting. When carrying out high temperature molten metal lifting, the safety distance between the furnace and the large tank, high pressure equipment, high pressure pipeline and pressure vessel shall comply with the relevant national standards or industry standards, and take effective protective measures.

Article 28 During the process of smelting, heat preservation, transportation and lifting of high-temperature molten metal, enterprises shall take safety measures to prevent leakage, splashing and explosion, and there shall be no non-productive stagnant water in the affected area.

The special route for high-temperature molten metal transportation should avoid the pipelines and cables such as gas, oxygen, hydrogen, natural gas, water pipes, etc.; if it is necessary to pass, the transportation vehicle should maintain sufficient safety distance between the pipeline and the cable, and take effective insulation measures. .

Vehicles that transport high-temperature molten metal are strictly prohibited from staying under pipes or cables and in areas with inflammable and explosive materials.

Article 29 Enterprises shall adopt rain-proof measures and effective drainage facilities for electric furnaces and electrolysis workshops to prevent rainwater from entering the lower floors of the troughs and to ensure that there is no water under the electric furnaces and electrolyzers.

Enterprises should set up facilities for emergency discharge and storage of molten metal for electric furnaces, casting smelting furnaces, holding furnaces, tilting furnaces, casting machines, fluid tanks, molten salt electrolyzers, etc., and set up barriers around the equipment to prevent The molten metal flows out.

Article 30 Cranes carrying high-temperature molten metal shall meet the requirements of "Safety Technical Supervision Regulations for Hoisting Machinery - Bridge Cranes" (TSGQ002) and "Regular Inspection Rules for Hoisting Machinery" (TSGQ7015).

The enterprise shall conduct safety inspection and flaw detection on the lifting and lifting of the spreader and the tank body (body, trunnion) of the molten metal.

Article 31 Enterprises that produce, store and use gas shall establish gas protection stations (groups), equipped with necessary gas protection personnel, gas detection and alarm devices and protective facilities, and organize at least one gas accident emergency drill every year.

Article 32 Enterprises that produce, store and use gas shall strictly implement the Gas Safety Regulations for Industrial Enterprises (GB6222), and set up fixed gas detection and alarm devices and safety warning signs in places where gas leakage and accumulation may occur.

Personnel entering the gas area should carry a portable carbon monoxide detection alarm device equipped with an air respirator, and the company arranges special personnel for safety management.

The gas cabinet area shall be provided with an isolation fence, and online monitoring equipment shall be installed, and the company shall arrange special personnel to be on duty. Fireworks are strictly prohibited in the gas cabinet area.

Article 33 The enterprises shall take effective measures for the production, transportation, use and storage of flammable and explosive hazardous chemicals such as gas, oxygen and hydrogen, as well as oil depots, cable tunnels (ditches) and other key fire prevention parts. Reliable fire, explosion and leakage protection measures.

For places with explosive atmospheres, enterprises shall set up automatic detection alarms and fire prevention devices in accordance with the "Electrical Equipment for Explosive Gas Environments" (GB3836) and the "Code for Design of Explosive Hazardous Environmental Power Equipments" (GB50058).

Article 34 Enterprises shall take anti-corrosion measures for reaction tanks, tanks, tanks, kettles, liquid storage tanks and pickling tanks, set up accident pools, conduct regular safety inspections, maintenance and maintenance, and conduct regular inspections to ensure normal operation. .

When the enterprise implements leaching and extraction operations, it shall take safety measures such as fireproof and explosion proof, anti-slot splashing and anti-poisoning.

Article 35 When an enterprise engages in electrolysis operations that cause acid mist hazards, measures shall be taken to prevent the spread of acid mist and the anti-corrosion of tanks and plants. The electrolysis workshop should keep the plant well ventilated and prevent the accumulation of hydrogen generated by electrolysis.

Article 36 In the workplace where acid or alkali is used, enterprises shall take measures to prevent burns of personnel and set up safe spraying or washing facilities.

In the electroplating and passivation of highly toxic materials, enterprises should set up accident pools under the plating tanks and strengthen the safety management of highly toxic substances.

Article 37 Enterprises shall take measures to prevent personnel poisoning in workplaces where toxic and harmful gases such as sulfur dioxide, chlorine, arsine, and hydrogen fluoride are present in the production process.

Enterprises should take measures to prevent heavy metal poisoning in workplaces where heavy metal vapors and dusts such as lead, cadmium, chromium, arsenic and mercury are present.

Article 38 An enterprise shall establish a system for examination and approval of large-scale dangerous operations, maintenance and repair operations, such as limited space, hot work, high-altitude operations, energy medium shutdown, implementation of work tickets (job tickets) and operation ticket management, and strictly implement internal Approval procedures, and arrange special personnel to carry out on-site safety management to ensure safe operation.

Article 39 Before the production device resumes production, the enterprise shall organize a safety inspection to confirm the safety conditions.

Chapter III Supervision and Management

Article 40 The department responsible for the supervision of metallurgical and colored safety production shall strengthen the supervision and inspection of the safety production of enterprises, clarify the main body of safety production supervision and management of each enterprise, and find that there are hidden dangers in accidents, which shall be dealt with in a timely manner; In case of hidden dangers, the implementation of listing supervision.

Article 41 The department responsible for the supervision of metallurgical and colored safety production shall incorporate the establishment of the double prevention mechanism for enterprise safety production standardization construction, safety production risk management and control and hidden danger investigation and control into the annual production safety inspection and inspection plan, and check and supervise according to the plan. Article 42 The department responsible for the supervision of metallurgical and colored safety production shall strengthen the training of the professional knowledge of metallurgical and non-ferrous metal safety production of supervision and inspection personnel and improve their administrative law enforcement capabilities.

Article 43 The department responsible for the supervision of metallurgical and colored safety production shall provide necessary personal protective equipment and monitoring and inspection equipment for personnel who are inspected and inspected into specific working places such as limited space.

Article 44 The department responsible for the supervision of metallurgical and colored safety production shall strengthen the filing management of the enterprise's emergency plan in its administrative region, and incorporate the emergency response of major accidents into the emergency rescue system of the local people's government.

Chapter IV Legal Liability

Article 45 If supervisors and inspectors abuse their powers, neglect their duties or engage in malpractices for personal gains during supervision and inspection of enterprises, they shall be punished in accordance with relevant regulations; if they constitute a crime, they shall be investigated for criminal responsibility according to law.

Article 46 If an enterprise violates the provisions of Articles 24 to 37 of these Provisions and constitutes a hidden danger of a production safety accident, it shall be ordered to immediately eliminate or eliminate the hidden dangers of the accident within a time limit; if the enterprise refuses to implement it, it shall order it to suspend production and suspend business for rectification. A fine of not less than 100,000 yuan but not more than 500,000 yuan shall be imposed, and the person directly in charge and other directly responsible personnel shall be fined not less than 20,000 yuan but not more than 50,000 yuan.

Article 47 Any other illegal act of an enterprise that violates these Provisions shall be investigated for legal responsibility in accordance with the provisions of the Law of the People's Republic of China on the Safety Production Law and the Law of the People's Republic of China on the Prevention and Control of Occupational Diseases.

Chapter V Supplementary Provisions

Article 48 These Provisions shall come into force on March 1, 2018.
